Important Disclosures ELECTRONIC NOTICE DISCLOSURE AND CONSENT FOR THE PEOPLE’S UNITED BANK PLATINUM CREDIT CARD This Electronic Notice Disclosure and Consent (the "Consent") contains important information about how we will deliver disclosures and notices required by applicable law to you, including the [Terms and Conditions of AccessMyCardOnline] (the "Agreement") and disclosures related to the provision of online credit card account services thereunder (the "Service"). We will call these disclosures the "Notices." This is your copy of the Consent. Please read it carefully and print and retain a copy of it for your records. Consent to Electronic Notices. By submitting your online application, you affirmatively consent to receive, and acknowledge that you can access, receive and retain the Notices electronically, by electronic means, and not in paper or non-electronic form. You further acknowledge that by accessing the website, you satisfy the hardware and software requirements discussed more fully below and acknowledge that you have reasonably demonstrated that you can access, receive and retain the Notices electronically in the formats we use.The decision to do business electronically is yours. You cannot apply electronically for the Service unless you agree to receive the Notices in electronic form. However, you may ask us to provide you with paper copies of the Notices by calling us at 1-800-426-1114. Paper copies of the Notices will be provided to you at no cost. Receiving Notices Electronically. We will provide Notices as part of your enrollment process or post Notices on the website with appropriate notice to you as permitted by applicable law. We will consider your acceptance of the Notice as your confirmation of receipt of the Notice. You agree to notify us promptly if your mailing address, e-mail address or other information changes by calling us at 1-800-426-1114 or by writing to us at Credit Card Services, P.O. Box 7092, Bridgeport, CT 06601. Hardware and Software Requirements. In order to access the website and to access, receive and retain the Notices electronically, you must provide at your own expense all necessary telephone lines, Internet or other connections and equipment needed. In addition, your personal computer must meet the following minimum requirements: Microsoft® Internet Explorer 5.0 or higher, Netscape 4.7 or higher (except 6.0), or AOL 5.0 or higher with 128-bit encryption. You must also have a printer that is capable of printing from your Internet web browser and e-mail software. You confirm that your computer satisfies these specifications and requirements and that you can access, receive and retain the Notices electronically. Withdrawal of Consent to Electronic Notices. If you agree to receive the Notices electronically, you can withdraw your consent at any time by calling us at 1-800-426-1114 or by writing to us at Credit Card Services, P.O. Box 7092, Bridgeport, CT 06601. You will not be charged a separate fee if you choose to withdraw your consent; however, the Agreement and your access to, and use of, the Service will automatically be terminated. Termination of the Consent will not affect the legal validity, enforceability and binding effect of any Notice, electronic or otherwise, before the effective date of the termination of the Consent. The terms of your account are governed by the Credit Card Agreement (Agreement) that will be sent with your card. Account terms, including Annual Percentage Rates (APRs), fees and costs, may be changed at any time as provided in the Agreement.

We reserve the right to change the terms (including APRs) at any time for any reason, in addition to APR increases that may occur for failure to comply with the terms of your account. The Higher Standard Rates may vary monthly and are determined by adding up to 8.99 percentage points to the margins used to determine the Standard Rates for Purchases, Balance Transfers and Cash Advances and then adding the new higher margins to the Index. The Higher Standard Rates will not exceed the Default Rate. ** On the first day of your ninth billing cycle, your APR for Purchases and Balance Transfers will be set at the Index plus a margin of 8.99 percentage points. Thereafter, your APR for Purchases and Balance Transfers may vary monthly and will be reset on the first day of each billing cycle by adding the Index to a margin of 8.99 percentage points. The Index is determined on the last business day of each month and is the highest Prime Rate published in the northeastern edition of The Wall Street Journal in its Money Rates table at any time within the immediately preceding three months, including the month in which the Index was determined. ‡ Cash Equivalent Transactions are those transactions performed using a merchant or service provider that Visa® or MasterCard® identifies as a seller of travelers’ checks, foreign currency, money orders, wire transfers, lottery tickets, funds used for wagers or gambling, or similar products or services. The information about the costs of the card described in this application is accurate as of January 1, 2009. This information may have changed after that date. Other important information about this credit card account: Unless a special promotional offer applies, there is no grace period for Balance Transfers and Cash Advances. We may apply payments to the amounts you owe in any order we choose. We may at our sole option and without notice to you change the order in which we apply payments. Important information about procedures for opening a new account: To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify and record information that identifies each person who opens an account. What this means for you: When you open an account, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver's license or other identifying documents. Arbitration: If you are approved for an account, we may require any disputes to be resolved by binding arbitration. Please read the "Arbitration" section of the Agreement carefully. STATE LAW DISCLOSURES Notice to Ohio Residents: The Ohio laws against discrimination require that all creditors make credit equally available to all credit worthy customers, and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio Civil Rights Commission administers compliance with this law. PAYMENTCARE(SM) DEFINITIONS: PaymentCare(SM) provides you, the Primary Applicant, with the following Benefits: Accidental Death: cancels your account balance in full, up to $20,000, if you should die as a result of an accidental injury. Involuntary Unemployment: cancels the Minimum Payment owed on your account for a maximum of 12 months if you become involuntarily unemployed (layoff, employer termination, generalized strike, unionized labor dispute or lockout) for at least 30 consecutive days. Disability: cancels the Minimum Payment owed on your account for a maximum of 12 months if you become totally unable to perform the major duties of your occupation due to a sickness or injury for at least 30 consecutive days. Family Leave of Absence: cancels the Minimum Payment owed on your account for a maximum of 6 months if you take an unpaid leave from full-time employment for at least 30 consecutive days due to caring for an immediate family member with a serious medical condition, caring for a newborn or adopted child, jury duty, or residing in a federally declared disaster area. Hospitalization: cancels the Minimum Payment owed on your account for a maximum of 24 months if you become hospitalized for three consecutive nights in a calendar month. Military Duty: cancels the Minimum Payment owed on your account for a maximum of 24 months if you receive a mandatory recall to active military duty for at least 30 consecutive days. Life Events: cancels the Minimum Payment owed on your account for two months if you get married, adopt a child, retire from your principal employment, graduate from an accredited 4-year college or university, or move to a new primary residence. During months that you have an account balance, your monthly fee is 89¢ per $100 of the highest billing cycle balance on your account. This fee is automatically included on your billing statement each month. ELIGIBILITY REQUIREMENTS: Benefits are based on the amount of your account balance as of the day before your loss occurs or $20,000, whichever is less, and do not include any amounts added to your account after the occurrence. To be eligible for Involuntary Unemployment, Disability, Family Leave of Absence and Military Duty Benefits, you must be employed on a full time basis for at least 30 hours a week at the time of the occurrence. To qualify for Involuntary Unemployment Benefits, you must register with a recognized employment agency or your state unemployment office within 30 days after the date you become unemployed. Accidental Death Benefits do not cover suicide or self-inflicted injuries. Disability, Family Leave of Absence and Hospitalization Benefits do not cover occurrences caused by a pre-existing medical condition. A "pre-existing condition" is one for which you or your family member saw or were treated by a licensed health care provider both within the 6 months before and the 6 months after your enrollment effective date. Once your enrollment is processed, you will receive a personalized Fulfillment Package along with additional details about PaymentCare. PaymentCare protection is available only to United States residents, residing in the United States.
